These terms and conditions outline the rules and regulations for the use of Clayton Ghost Walks, LLC's Website, located at https://claytonghostwalks.com.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Clayton Ghost Walks if you do not agree to take all of the terms and conditions stated on this page.

IN CONSIDERATION for being permitted to participate in “Clayton Ghost Walks” operated by Clayton Ghost Walks, LLC and for other good and valuable consideration - the participant, for himself/herself, as well as for his or her child or ward, if applicable, and his or her and their (if applicable) personal representatives, heirs, and next of kin: acknowledges the risk of personal injury that may arise or happen at any time. All participants agree that they are participating of their own free will and are not compelled to participate and further that: (i) the participant understands that the particular activities may involve, for example, adverse weather conditions, lifting, walking on uneven terrain, entering old buildings, running, physical exercise, and/or physical contact with others. ; (ii) the participant understands that all activities related to the walking tour may or may not be supervised; (iii) the participant understands that Clayton Ghost Walks, LLC is not a health care provider and emergency care may not be immediately available in the event of an injury or health event during the walking tour; and (iv) the participant is in sufficient physical condition and is physically able to undertake all the activities, ; has no disability, impairment or ailment preventing him or her from active or passive exercise, or that will be detrimental to his or her health, safety, comfort or condition if the participant does so engage or participate.

HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Clayton Ghost Walks, LLC, THEIR SUBSIDIARY, OR AFFILIATE THEREOF, AND EACH OF THEM, THEIR EMPLOYEES, ALL FOR THE PURPOSES HEREIN REFERRED TO AS “RELEASEES,” FROM ALL LIABILITY, TO THE PARTICIPANT, THE PARTICIPANT'S PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, AND NEXT OF KIN FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO THE PERSON (INCLUDING EXPOSURE TO AND THE CONTRACTING OF COVID-19 OR OTHER INFECTIOUS DISEASE) OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE ACTIVITIES OCCURRING WHILE PARTICIPATING IN THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, GOOD SAMARITAN ACTS, OR OTHERWISE

HEREBY AGREES and gives the event photographer/videographer, if any, as well as such photographer’s/videographer’s, the irrevocable right to use and to license my photograph in all forms and in all media and in all manners, without any restriction as to changes or alterations for any uses including but not limited to advertising, trade, promotion, and marketing, or any other lawful purposes. The participant waives any right to inspect or approve the photograph(s) or finished version(s) incorporating the photograph(s). The participant agrees that the photographer/videographer owns the copyright in these photographs.

In consideration of Clayton Ghost Walks allowing the participant to participate in the walk, and possible use of facilities and venues, the participant agrees to assume the foreseeable and unforeseeable risk of personal injuries related to the activity, and agrees to release, discharge, and hold harmless Clayton Ghost Walks, its owner(s) and employees free from any and all liabilities, claims, cause of action, damages, or losses, which may be incurred by the participant in using said premises and their participation in any walks, and which may arise from any reason whatsoever, specifically including, but not limited to, any negligence on the part of the owners, its employees, or losses arising from theft or for any other reason whatsoever.

This Waiver shall be binding upon the parties, their respective heirs, representatives, successors, and assigns.

In case any part of this Waiver be construed as improper or invalid, such invalidity will affect only that part of this Waiver and the rest shall remain valid and enforceable.

Any alteration, modification, or amendment to this Waiver shall not be considered as valid unless otherwise written and signed by the undersigned herein.

Unless otherwise stated, Clayton Ghost Walks, LLC and/or its licensors own the intellectual property rights for all material on Clayton Ghost Walks. All intellectual property rights are reserved. You may access this from Clayton Ghost Walks for your own personal use subjected to restrictions set in these terms and conditions.
